Terms & Conditions.

These Terms and Conditions form a legally binding agreement between Luxe Boudoir (“Photographer”) and the Client.

By paying the Session Fee the Client accepts these Terms.

SERVICES

Your booking includes a luxury photography experience and professional image editing. Professional hair and makeup is included where specified at the time of booking.

SESSION FEE

A Session Fee is required to secure your chosen date.

This fee reserves studio time exclusively for you and covers preparation, planning and administration. It is not payment solely for hair, makeup, products or digital images. The Session Fee is non-refundable for change of mind.

The Session Fee covers the Photoshoot Experience only and does not include digital images, printed products or artwork unless otherwise stated. Image Collections begin at $599, which is the minimum purchase required at your Reveal and Ordering Appointment. The Session Fee is valid for 12 months from the date of payment and will expire if not used within this period, unless otherwise agreed in writing by Luxe Boudoir.

This does not affect your rights under Australian Consumer Law.

RESCHEDULING & CANCELLATION

If you need to move your session, at least 48 hours’ written notice is required. Your Session Fee may then be transferred to one new date, subject to availability.

Only one reschedule is permitted.

If cancellation occurs within 48 hours of the session or the Client fails to attend, the Session Fee is forfeited.

If the Photographer is unable to perform the session due to circumstances beyond reasonable control, reasonable efforts will be made to reschedule. If rescheduling is not possible, amounts paid for Services not supplied will be refunded.

SESSION CONDITIONS

The Client must be at least 18 years of age.

Boudoir sessions may involve posing in minimal or no clothing. The Client participates voluntarily and may decline any pose.

The Photographer retains creative control over lighting, posing, editing style and final image selection. RAW images are not provided. Re-shoots are not provided for subjective dissatisfaction.

The Client is responsible for wardrobe and styling choices. The Photographer may provide recommendations, however all final decisions remain with the Client.

HAIR & MAKEUP

Where third-party hair and/or makeup artists are engaged, they operate as independent contractors. The Client is responsible for disclosing any allergies or sensitivities.

If a Hair and Makeup Artist becomes unavailable due to illness or unforeseen circumstances, Luxe Boudoir will make reasonable efforts to arrange a suitable replacement or reschedule the session if necessary.

REVEAL AND ORDERING APPOINTMENT

Following the Photoshoot Experience, the Client will attend an Ordering Appointment where image selections and purchases are made. No digital images, printed products or artwork are included in the Session Fee unless otherwise stated.

PAYMENT & DELIVERY

No images or products will be delivered until all outstanding amounts are paid in full. Payments are non-refundable for change of mind.

COPYRIGHT & USE

All images remain the copyright property of the Photographer under the Copyright Act 1968 (Cth).

Purchased images are licensed to the Client for personal use only and may not be sold, commercially reproduced or materially altered without written permission.

PRIVACY

Images will not be used for marketing or promotional purposes without the Client’s consent.

LIABILITY

To the extent permitted by law, the Photographer’s liability for any claim arising from the Services is limited to resupplying the Services or refunding the portion of fees paid for Services not supplied.

HEALTH & SAFETY

The Photographer will take reasonable care to maintain a safe studio environment.
The Client must advise the Photographer of any injuries, medical conditions or physical limitations prior to the session.

GOVERNING LAW

This Agreement is governed by the laws of Queensland, Australia.
